HORSE TRAINING CONTRACT
WITNESS THIS AGREEMENT this day of _________________ , 20_____ , by and between ____________________ (hereinafter referred to as "Trainer") and _____________________ (hereinafter referred to as "Owner"), and if Owner is a minor, Owner's parent or guardian.

for training, and it is the plan and intention of the Owner to place this horse(s) into training.
1. Fees, Terms, and Location
Owner shall pay the Trainer for professional services and board as described below, the fee of $ per month. Changes in monthly rates or other charges are subject to alteration upon 30 days' notice to Owner. All fees for training and other incidental services are due upon receipt of invoice. All out-of-pocket expenses incurred during the month shall be added to the following month's bill by Trainer. Veterinary expenses will be handled directly between Owner and Veterinarian.
2. Payment of Invoices
Invoices are payable upon receipt, and late after 15 days. Late fees will be applied after 30 days. Upon completion of this agreement, the remainder of any and all expenses shall be due and payable immediately and the animal will not be released from Trainer's possession until all expenses are paid in full. In the event payment is overdue by 30 days, Trainer shall be entitled to a lien against the horse and/or equipment stored upon Trainer's premises in the full amount due. Enforcement of said lien shall be at the discretion of Trainer, who may sell the horse and/or equipment for amounts outstanding in accordance with the appropriate laws of the applicable state.
3. Right of Lien
Trainer reserves the right of lien as set forth in the laws of the State of upon failure to pay bills and fees.
4. Veterinarian, Shoeing, and Related Services
Trainer assumes responsibility for arranging veterinarian and farrier services as necessary. Trainer will use a veterinarian and farrier of Trainer's choice to provide ordinary and necessary care unless Owner has requested Owner's veterinarian or farrier, in which case Owner is responsible for all arrangements. However, if they are unavailable, Trainer will engage Trainer's choice. All veterinarian, farrier, and medicine expenses shall be paid by Owner. Owner agrees to provide Trainer with all health records for the horse(s). Horses are required to follow Trainer's wormer and vaccination schedule. Trainer reserves the right to refuse any horse if the horse does not appear to be in good health or is deemed dangerous or undesirable.
5. Training of Horse
Trainer shall train horses and perform all services in accordance with generally accepted professional standards. Trainer cannot and does not guarantee the effect of the training program or that any particular result will be achieved, as this depends greatly on the individual physical and mental ability of each horse. Trainer shall furnish all labor, provide suitable facilities, and care for the horse in an adequate manner with feed being determined by Trainer. Trainer has complete control over the manner of training and shall take all precautions for proper performance thereof.
6. Showing of Horse
Trainer reserves the right to choose whether or not to show the horse and which shows to attend. Trainer and Owner must agree on all classes the horse is to be exhibited. Owner agrees to pay the following show expenses: day fees, hauling fees, lodging fees, and show fees if applicable. In the event that Trainer shows Owner's horse, Trainer will receive % of money earnings and Owner will receive % of money earnings. All other prizes won will be divided equally between Trainer and Owner.
7. Death of Horse
In the event of death of the horse, this contract is terminated and all existing fees and expenses up to the date of death are due in full within 10 days.
8. Risk of Loss and Standard of Care
During the time that horse(s) is/are in the custody of Trainer, Trainer shall not be liable for any sickness, disease, going astray, theft, death, or injury which may be suffered by the horse(s), or any other cause of action whatsoever arising out of or connected in any way with the boarding of said horse(s), except in the event of negligence on the part of Trainer, its agents, and/or employees. This includes, but is not limited to, any personal injury or disability the horse Owner or Owner's guests may receive on Trainer's premises.
Owner fully understands that Trainer does not carry any insurance on horses not owned by Trainer. All risks connected with boarding or for any other reason for which horse(s) are in the possession of and on the premises of Trainer are to be borne by Owner. In no event shall Trainer be held liable to Owner for equine death or injury.
Owner agrees to obtain equine insurance for any animals at Owner's expense, or forego any claim for any amount. Owner agrees to disclose this entire agreement to Owner's insurance company and provide Trainer with the company's name, address, and policy number. Failure to disclose insurance information shall be at Owner's risk.
9. Inherent Risks and Assumption of Risk
The undersigned acknowledges there are inherent risks associated with equine activities, including but not limited to: the propensity of equines to behave in ways such as running, bucking, biting, kicking, shying, stumbling, rearing, falling, or stepping on persons, which may result in injury, harm, or death; the unpredictability of an equine's reaction to sounds, sudden movements, and unfamiliar objects, persons, or other animals; certain hazards such as surface conditions and collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others.
Owner hereby expressly assumes all risks associated with participating in equine activities and expressly releases Trainer and stable from any and all claims for personal injury or property damage.
10. Hold Harmless
Owner agrees to hold Trainer harmless from any and all claims arising from damage or injury caused by said horse(s) to anyone, and to defend Trainer from any such claims. Owner agrees to disclose any and all hazardous or dangerous propensities of horse(s) placed with Trainer. Trainer reserves the right to notify Owner within 7 days of the horse's arrival if said horse, in Trainer's opinion, is dangerous, untrainable, unhealthy, handicapped, or otherwise unfit for training. Upon such notification, Owner shall remove said horse within 7 days, and all expenses incurred for the horse's stay shall be paid prior to departure.
11. Emergency Care
In the event of an emergency, Trainer reserves the right to contact a veterinarian for emergency treatment. All costs will be billed to Owner. Trainer will update Owner on the situation as needed. Trainer shall assume that Owner desires surgical care if recommended by a veterinarian in the event of a life-threatening illness, unless Trainer is instructed herein by Owner that the horse is not a surgical candidate. Owner agrees to notify Trainer of any and all changes of address, emergency telephone numbers, itineraries, or other information reasonably necessary to contact Owner in the event of an emergency.
12. Limitations of Actions
Any action or claim brought by Owner against Trainer for breach of this contract or for loss due to negligence must be brought within 1 year of the date such claim or loss occurs.
13. Coggins Test
Horse will be required to have a current negative Coggins test on file with Trainer at all times, at Owner's expense.
14. Changes or Termination of This Agreement
It is agreed by the parties that this agreement may be changed or terminated by Trainer upon 30 days' written notice, regardless of the training period. The posting of updated rate schedules in a conspicuous place in Trainer's office shall constitute notice of any rate or regulation changes.
15. Rules and Regulations
Owner agrees to abide by all the rules and regulations of Trainer. In the event someone other than Owner shall call for the horse(s), such person shall have written authority signed by Owner to obtain said horse(s).
16. Property in Storage on Trainer's Premises
Owner may store certain tack and equipment on the premises of Trainer at no additional charge to Owner. Trainer shall not be responsible for the theft, loss, damage, or disappearance of any tack or equipment stored at the facility; all property is stored at Owner's risk. Trainer shall not be liable for theft, loss, damage, or disappearance of any tack or equipment belonging to Owner when taken off the facility to horse shows, clinics, or any other location related to training.
WARNING: Under the equine activity liability laws of many states, an equine activity sponsor or equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities. Owner is advised to consult the applicable laws of their state.

I/we the undersigned have read and understand the foregoing agreement, warnings, assumption of risk, and release. I/we further attest that all stated facts are true and accurate. If Owner is a child or minor, a parent or legal guardian must sign.
